Church Civil Immunity and Legal ABC’s for Churches

OVERVIEW:

This workshop will examine potential liability for safety team members and churches as well as discuss actions that safety team members may take to minimize their exposure to criminal prosecution and/or civil liability. We will discuss the doctrines of necessity and the use of force including deadly force. We will discuss what and how to interact with law enforcement following an incident.

We will explain the impact and details of Texas Senate Bill 694 regarding immunity for safety team members and churches. Including the requirements that churches must meet to qualify requirements to receive immunity.

GOALS:

  • Provide Churches the information and tools to understand and minimize their liability exposure

  • Be better prepared to interface with responding LEO

  • Clear understanding to Texas Senate Bill 696 and the church’s requirements to claim immunity under the Bill

PRESENTER:

Sean Healy is an attorney in private practice in Tyler, Texas with extensive experience and background on weapons and the Use of Force.

He is the lead author of the book The Legal Guide to NFA Firearms and Gun Trusts and the Treasurer and General Counsel for the Texas State Rifle Association . He was Course Director for the State Bar Firearms Law Seminars 2012 and 2013 and was Co-Director of the 2024 Seminar.

Sean has been an invited speaker at various State Bar events as well as the 2022 NRA National Firearms Law Seminar.

Sean is licensed by the Texas Department of Public Safety as a Level 3 Range and Classroom private security instructor, a Personal Protection Officer (Level 4), and is on the faculty for a local PPO Academy. He is a Texas license to carry instructor and an NRA-Certified Instructor and Training Counselor (instructor trainer), with multiple certifications. He is an NRA Chief Range Safety Officer. He is a nationally-trained instructor trainer for Texas 4-H Shooting Sports, and is a force-on-force instructor.
